Compass, LLC is committed to protecting the privacy of your information. This Privacy Statement outlines Compass LLC’s information data security practices.

Compass, LLC supports the effort to build users’ trust and confidence on the Internet by promoting the use of fair information practices. Compass, LLC also abides by the EU Safe Harbor Framework as outlined by the U.S. Department of Commerce and the European Union. 1.         Web Sites and Databases Covered

This Privacy Statement covers the information practices of Web sites and Databases that link to this Privacy Statement. When sites are posted by Compass, LLC, the site will link to this Privacy Statement, and this Privacy Statement applies. When sites or data are posted by third parties, the privacy statement of the third party applies, and this Privacy Statement does not apply.

The QSP Web sites may contain links to other Web sites. Compass, LLC is not responsible for the information practices or the content of such other Web sites. Compass, LLC encourages you to review the privacy statements of other Web sites to understand their information practices.

2.         Personal Information Collected

Compass, LLC offers a variety of services that are collectively referred to as the “Service.” Compass, LLC collects information from individuals who visit the Company’s Web sites (“Visitors”) and individuals who register to use the Service (“Customers”).

When expressing an interest in obtaining additional information about the Service or registering to use the Service, Compass, LLC requires you to provide the Company with contact information, such as name, company name, address, phone number, and e-mail address (“Required Contact Information”). When purchasing the Service, Compass, LLC requires you to provide the Company with financial qualification and billing information, such as billing name and address, credit card number, and the number of employees within the organization that will be using the Service (“Billing Information”). Compass, LLC may also ask you to provide additional information, such as company annual revenues, number of employees, or industry (“Optional Information”). Required Contact Information, Billing Information, and Optional Information are referred to collectively as “Data About Compass, LLC Customers.”

As you navigate the Company’s Web sites, Compass, LLC may also collect information through the use of commonly used information-gathering tools, such as cookies and web beacons (“Web Site Navigational Information”). Web Site Navigational Information includes standard information from your web browser (such as browser type and browser language), your Internet Protocol (“IP”) address, and the actions you take on the Company’s Web sites (such as the web pages viewed and the links clicked).

3.         Use of Information Collected

The Company uses Data About Compass, LLC Customers to perform the services requested. For example, if you fill out a “Contact Me” Web form, the Company will use the information provided to contact you about your interest in the Service.

The Company may also use Data About Compass, LLC Customers for marketing purposes. For example, the Company may use the information you provide to contact you to further discuss your interest in QSP, the Service, and to send you information regarding the Company and its partners, such as information about promotions or events.

Compass, LLC uses credit card information solely to check the financial qualifications of prospective Customers and to collect payment for the Service.

Compass, LLC uses Web Site Navigational Information to operate and improve the Company’s Web sites. The Company may also use Web Site Navigational Information in combination with Data About Compass, LLC Customers to provide personalized information about the Company.

4.         Web Site Navigational Information

Compass, LLC uses commonly used information-gathering tools, such as cookies and web beacons, to collect information as you navigate the Company’s Web sites (“Web Site Navigational Information”). This section describes the types of Web Site Navigational Information the Company may collect and how the Company may use this information.

Cookies

Compass, LLC uses cookies to make interactions with the Company’s Web sites easy and meaningful. When you visit one of the Company’s Web sites, Compass, LLC’s servers send a cookie to your computer. Standing alone, cookies do not personally identify you. They merely recognize your web browser. Unless you choose to identify yourself to Compass, LLC, either by responding to a promotional offer, opening an account, or filling out a web form (such as a “Contact Me” or a “30-Day Free Trial” web form), you remain anonymous to the Company.

There are two types of cookies: session-based and persistent-based. Session cookies exist only during one session. They disappear from your computer when you close your browser software or turn off your computer. Persistent cookies remain on your computer after you close your browser or turn off your computer.

If you have chosen to identify yourself to Compass, LLC, the Company uses session cookies containing encrypted information to allow the Company to uniquely identify you. Each time you log into the Service, a session cookie containing an encrypted, unique identifier that is tied to your account is placed in your browser. These session cookies allow the Company to uniquely identify you when you are logged into the Service and to process your online transactions and requests. Session cookies are required to use the Service.

Compass, LLC uses persistent cookies that only the Company can read and use to identify browsers that have previously visited the Company’s Web sites. When you purchase the Service or provide the Company with personal information, a unique identifier is assigned to you. This unique identifier is associated with a persistent cookie that the Company places on your web browser. The Company is especially careful about the security and confidentiality of the information stored in persistent cookies. For example, the Company does not store account numbers or passwords in persistent cookies. If you disable your web browser’s ability to accept cookies, you will be able to navigate the Company’s Web sites, but you will not be able to successfully use the Service.

Compass, LLC may use information from session and persistent cookies in combination with Data About Compass, LLC Customers to provide you with information about the Company and the Service.

Web Beacons

Compass, LLC uses web beacons alone or in conjunction with cookies to compile information about Customers and Visitors’ usage of the Company’s Web sites and interaction with e-mails from the Company. Web beacons are clear electronic images that can recognize certain types of information on your computers, such as cookies, when you viewed a particular Web site tied to the web beacon and a description of a Web site tied to the web beacon. For example, Compass, LLC may place web beacons in marketing emails that notify the Company when you click on a link in the e-mail that directs you to one of the Company’s Web sites. Compass, LLC uses web beacons to operate and improve the Company’s Web sites and e-mail communications. Compass, LLC may use information from web beacons in combination with Data About Compass, LLC Customers to provide you with information about the Company and the Service.

IP Addresses

When you visit Compass, LLC’s Web sites, the Company collects your Internet Protocol (“IP”) addresses to track and aggregate non-personally identifiable information. For example, Compass, LLC uses IP addresses to monitor the regions from which Customers and Visitors navigate the Company’s Web sites.

Compass, LLC also collects IP addresses from Customers whey they log into the Service as part of the Company’s “Identity Confirmation” and “IP Range Restrictions” security features.

Third-Party Cookies

From time-to-time, Compass, LLC engages third parties to track and analyze non-personally identifiable usage and volume statistical information from individuals who visit the Company’s Web sites. Compass, LLC may also use other third-party cookies to track the performance of Company advertisements. The information provided to third parties does not include personal information, but this information may be re-associated with personal information after the Company receives it. This Privacy Statement does not cover the use of third-party cookies.

5.         Public Forums, Refer a Friend, and Customer Testimonials

Compass, LLC may provide bulletin boards, blogs, or chat rooms on the Company’s Web sites. Any personally identifiable information you choose to submit in such a forum may be read, collected, or used by others who visit these forums and may be used to send you unsolicited messages. Compass, LLC is not responsible for the personally identifiable information you choose to submit in these forums.

Customers and Visitors may elect to use the Company’s referral service to inform friends about the Company’s Web sites. When using the referral service, the Company requests the friend’s name and e-mail address. Compass, LLC will automatically send the friend a one-time e-mail inviting him or her to visit the Company’s Web sites. Compass, LLC does not store this information.

Compass, LLC posts a list of Customers and testimonials on the Company’s Web sites that contain information such as Customer names and titles. Compass, LLC obtains the consent of each Customer prior to posting any information on such a list or posting testimonials.

6.         Sharing of Information Collected

Compass, LLC may share Data About Compass, LLC Customers with the Company’s agents so that these agents can contact Customers and Visitors who have provided contact information on our behalf. Compass, LLC may also share Data About Compass, LLC Customers with the Company’s agents to ensure the quality of information provided. Compass, LLC does not share, sell, rent, or trade personally identifiable information with third parties for their promotional purposes.

Compass, LLC uses a third-party intermediary to manage credit card processing. This intermediary is not permitted to store, retain, or use Billing Information except for the sole purpose of credit card processing on the Company’s behalf.

Compass, LLC reserves the right to disclose personally identifiable information of the Company’s Customers or Visitors if required by law or if the Company reasonably believes that disclosure is necessary to protect the Company’s rights and/or to comply with a judicial proceeding, court order, or legal process.

7.         Communications Preferences

Compass, LLC offers Customers and Visitors who provide contact information a means to choose how the Company uses the information provided. You may manage your receipt of marketing and non-transactional communications by clicking on the “unsubscribe” link located on the bottom of the Company’s marketing e-mails. Additionally, you may send a request specifying your communications preferences to info@quicksolveplus.com. Customers cannot opt out of receiving transactional e-mails related to their account with Compass, LLC or the Service.

8.         Correcting and Updating Your Information

Customers may update or change their registration and billing information for their user and/or organization record. To do this, please log in to https://www.quicksolveplus.com/my-account with the user name and password created during setup. You can also e-mail info@quicksolveplus.com or call [385-743-8777]. To discontinue your account and to have information you maintained in the Service returned to you, please e-mail info@quicksolveplus.com or call [385-743-8777]. Requests to access, change, or delete your information will be handled within 30 days.

9.         Customer Data

Compass, LLC Customers use the Service to host data and information (“Customer Data”). Compass, LLC will not review, share, distribute, or reference any such Customer Data except as provided in the QSP Master Subscription Agreement, or as may be required by law. Individual records of Customer Data may be viewed or accessed with an administrative log in only for the purpose of resolving a problem, support issues, confirming subscription pricing tier, or suspected violation of the QSP Master Subscription Agreement, or as may be required by law. Customers are responsible for maintaining the security and confidentiality of their QSP usernames and passwords.

10.       Security and Hosting

Compass, LLC uses robust security measures to protect Customer Data from unauthorized access, maintain data accuracy, and help ensure the appropriate use of Customer Data. These technologies help ensure that Customer Data is safe, secure, and only available to the Customer to whom the information belongs and those to whom the Customer has granted access. Compass, LLC also implements an advanced security method based on dynamic data and encoded session identifications, and the Company hosts its Web sites in a secure server environment that uses firewalls and other advanced technology to prevent interference or access from outside intruders. Compass, LLC also offers enhanced security features within the Service that permit Customers to configure security settings to the level they deem necessary.

Because the Company uses the Service to maintain Data About Compass, LLC Customers, this information is secured in the same manner as described above for Customer Data.

Compass, LLC uses Rackspace Technologies as a 3rd party datacenter to host Customer Data. Compass, LLC has a HIPAA Business Agreement with Rackspace that can be viewed here.

11.       Changes to this Privacy Statement

Compass, LLC reserves the right to change this Privacy Statement. Compass, LLC will provide notification of the material changes to this Privacy Statement through the Company’s Web sites at least thirty (30) business days prior to the change taking effect.

US—EU Safe Harbor Privacy Policy

Compass, LLC adheres to the Safe Harbor Principles administered by the United States Department of Commerce in consultation with the European Commission with respect to personal information within the scope of this Policy.

Scope

QSP generally does not collect personal information directly from individuals in the European Union (“EU”).  Instead, QSP merely acts as a data processor for its customers.  This Policy applies to personal information knowingly received and processed by QSP in the United States from the EU, specifically, personal information collected from Compass, LLC’s business customers concerning their employees or customers in the context of the services QSP performs and about Compass, LLC employees.

Definitions

“Personal information” means information that identifies or reasonably may identify a natural person.  Personal information does not include acceptable information or aggregate information to the extent an individual’s identity cannot reasonably be determined from such information.  In addition, Personal information does not include information as to which an individual has given explicit consent for use, consistent with the Safe Harbor Principles.

“Agent” means any third party that processes, collects, or uses personal information pursuant to the instructions of, and solely for the benefit of, Compass, LLC, or to which Compass, LLC discloses personal information for use on its behalf.

“Sensitive personal information” means personal information that reveals a natural person’s race, ethnic origin, political opinions, religious or philosophical beliefs, criminal record, or trade union membership, or that concerns a natural person’s sex life or health.

Privacy Principles

The privacy principles in this Policy are based on and shall be interpreted in a manner consistent with the Safe Harbor Principles.

Notice

Compass, LLC provides managed hosting and networking services to its customers, which may require QSP to process its customers’ data for the purpose of enabling or monitoring the functionality of the customer applications.  The customer data processed by QSP may include personal information.  This information is controlled by Compass, LLC’s customers and may be processed by QSP in order to provide the relevant services. Compass, LLC is not responsible for the content of the information QSP processes, which may include personal information, nor is it responsible for the way its customers treat the personal information they collect or control.

Choice

QSP generally does not collect personal information directly from individuals in the EU.  It merely acts as a data processor for its customers.  If QSP does collect information directly from individuals within the EU via its Web site, it will do so pursuant to its corporate Privacy Policy and, to the extent it is applicable and required by the Safe Harbor Principles, offer such individuals the choice to opt out of having their personal information disclosed to a third party that is not an agent or used for a purpose other than for which it was collected originally.

Onward Transfer

Compass, LLC will obtain reasonable assurances from any agents to whom it provides direct access to personal information that they will safeguard personal information knowingly collected by QSP concerning individuals residing in the EU consistent with this Policy and the Safe Harbor Principles.

Access

Upon an individual’s request, if feasible or applicable, Compass, LLC will offer individuals from whom it directly collects information reasonable access to their personal information and will afford such individuals a reasonable opportunity to correct, amend, or delete inaccurate information.  For commercial and security reasons, Compass, LLC may have to coordinate such access through its customer who controls the information. Compass, LLC may limit or deny access to personal information where providing such access would be unreasonably burdensome or expensive under the circumstances or as otherwise permitted by the Safe Harbor Principles.

Security

Compass, LLC will take reasonable measures including technical, physical, and administrative measures and training, as appropriate, to protect the personal information it collects and processes from loss, misuse, and unauthorized disclosure, access, alteration, and destruction.  Such measures apply generally across QSP systems, services, and facilities rather than to particular customer environments, which vary greatly and are often highly customized. Compass, LLC safeguards information according to established security standards and periodically assesses new technology for methods of protecting information.  However, Compass, LLC cannot guarantee the security of personal information.

Data Integrity

Compass, LLC generally does not determine the type of personal information collected by its business customers or the purpose for which it is collected.  It merely acts upon the instructions of such customers as a data processor.  If Compass, LLC does collect information directly from individuals within the EU, it will, to the extent it is applicable and required by the Safe Harbor Principles, take reasonable measures to verify that personal information it collects and processes is relevant for its intended use, reliable for its intended use, accurate, complete, and current.

Enforcement and Dispute Resolution

Compass, LLC will conduct periodic assessments to confirm the accuracy of, and verify its adherence to, this Policy. Compass, LLC will investigate suspected infractions and will take all appropriate action.  Any questions, concerns, or complaints concerning the collection and use of personal information by Compass, LLC should be directed to:

Compass, LLC will conduct a reasonable investigation into and will attempt to resolve any complaints in accordance with the principles contained in this Policy.  Complaints that cannot be resolved between Compass, LLC and the complainant shall be resolved via binding arbitration with the American Arbitration Association in accordance with its Commercial Arbitration Rules and Mediation Procedures.  Complainants seeking arbitration must send written notice to the Compass, LLC General Counsel at Compass, LLC, 1020 Market St. Dr., Redding, CA 96001.  A single arbitrator will be selected by Compass, LLC and the arbitration will be held in Redding, CA.  Each party will pay its own costs associated with the arbitration and agrees to split the arbitration fees.  Solely with respect to complaints by Compass, LLC employees that cannot be resolved internally, Compass, LLC agrees to work with the relevant Data Protection Authority to resolve such matter.

Limitations

Compass, LLC’s adherence to the Safe Harbor Principles may be limited by its role as a data processor as well as any applicable legal, regulatory, ethical, or public interest consideration, and as expressly permitted or required by any applicable law, rule, or regulation.  In addition, Compass, LLC reserves the right to disclose personal information reasonably related to the sale or disposition of all or part of its business.

Internet Privacy

Compass, LLC maintains a distinct Internet Privacy Policy governing the privacy of information collected by Compass, LLC online through its Web site, which can be viewed at: www.quicksolveplus.com.

Modification of this Safe Harbor Privacy Policy

Compass, LLC may amend this Policy from time to time with or without notice in accordance with the Safe Harbor Principles.  Any modified policy will be posted on the company’s Web site for public viewing.
